These terms govern your use of the JFWREALTOR website and the custom website services we provide. Please read them carefully before using our website or working with us.

JFWREALTOR provides custom website design, development, and related digital services for real estate professionals. These Terms of Service explain the rules that apply when you visit our website, book a consultation, request a proposal, or purchase services from us.

By using this website or engaging JFWREALTOR, you agree to these terms and our Privacy Policy.

Acceptance of terms

By accessing this website, submitting a form, booking a consultation, accepting a proposal, or purchasing a service, you confirm that you have read and agreed to these Terms of Service.

If you are acting on behalf of a business, brokerage, team, or other organization, you confirm that you have authority to bind that organization to these terms.

Services we provide

JFWREALTOR specializes in custom websites and digital services for real estate professionals. Depending on the agreed project scope, our services may include:

  • Custom website strategy, design, and development
  • Brand direction and visual design
  • Lead-generation forms and appointment booking
  • MLS or IDX integration assistance
  • Website hosting, maintenance, updates, and support
  • Additional features described in a proposal or service agreement

The exact deliverables, schedule, and responsibilities for a project will be described in the applicable proposal, invoice, or written agreement.

Quotes, pricing, and payments

Project pricing is based on the scope agreed before work begins. Quotes are valid for the period stated in the proposal and may be revised if the requirements, timeline, or deliverables change.

Payment terms may include:

  • An upfront deposit before work begins
  • Milestone or progress payments
  • Final payment before launch, transfer, or delivery
  • Recurring fees for hosting, maintenance, subscriptions, or support

Invoices must be paid by their stated due dates. We may pause work, delay launch, restrict access, or suspend ongoing services when a payment is overdue.

Additional work is not automatically included. Requests outside the agreed scope may require a revised timeline and additional fees.

Client responsibilities

To complete a project effectively, clients agree to provide accurate information, timely feedback, approvals, access credentials, and any materials reasonably required for the work.

Client-provided materials may include:

  • Logos, brand assets, photography, videos, and written content
  • Property, brokerage, agent, team, and contact information
  • Domain, hosting, MLS, IDX, CRM, or third-party account access
  • Legal disclosures, accessibility requirements, and regulatory content

Delays in receiving materials, feedback, approvals, or access may extend the project timeline. The client is responsible for confirming that all supplied content is accurate, lawful, and authorized for use.

Revisions and project scope

Revisions are limited to the amount or process described in the project proposal. A revision adjusts agreed work; it does not create a new design direction, page, feature, integration, or deliverable.

Major changes, repeated changes after approval, or work outside the original scope may be treated as additional work and quoted separately.

Intellectual property

Clients retain ownership of the logos, images, text, trademarks, and other materials they provide, and grant JFWREALTOR permission to use those materials to complete the project.

Unless a written agreement states otherwise, JFWREALTOR retains ownership of its pre-existing materials, reusable code, components, design systems, workflows, internal tools, techniques, and general know-how.

After all required payments are received, the client receives the rights described in the applicable proposal to use the final delivered website and project-specific materials.

Third-party services

A website may depend on third-party products and services such as domain registrars, hosting providers, MLS or IDX providers, scheduling tools, form processors, analytics platforms, plugins, APIs, fonts, or payment services.

Forms and schedulingLead delivery, contact requests, and appointment bookings.
Plugins and external APIsAdditional website functionality supplied by other companies.

Third-party services are governed by their own terms, prices, availability, and privacy practices. JFWREALTOR is not responsible for their outages, policy changes, discontinued features, data accuracy, or price increases.

Launch, support, and website availability

Launch dates are estimates unless expressly guaranteed in writing. Launch may depend on timely approvals, completed payments, third-party access, and delivery of required client materials.

We aim to provide reliable work and support, but cannot guarantee that any website, hosting platform, integration, or third-party service will operate without interruption or error at all times.

Cancellations and refunds

Either party may end a project by providing written notice. Fees already earned, completed work, approved milestones, third-party costs, and non-refundable deposits remain payable.

Because our services are customized and involve reserved time and completed labour, payments are generally non-refundable once work has begun. Any exception must be confirmed in writing.

Limitation of liability

To the fullest extent permitted by applicable law, JFWREALTOR will not be liable for indirect, incidental, special, punitive, or consequential losses, including lost revenue, lost profits, lost opportunities, data loss, or business interruption.

JFWREALTOR's total liability relating to a service will not exceed the amount the client paid to JFWREALTOR for the specific service giving rise to the claim.

Nothing in these terms excludes liability that cannot legally be excluded or limited.

Acceptable use

You may not use this website or any service we provide to break the law, infringe another person's rights, distribute malicious software, attempt unauthorized access, interfere with security, submit deceptive information, or misuse website infrastructure.

Changes to these terms

We may update these Terms of Service when our website, services, business practices, or legal obligations change. The current version will be posted on this page with a revised update date.

Continued use of the website after an update means you accept the revised terms.
